Activities of the Ministry of Justice in the field of international legal assistance


Today, the development of the immigration process of citizens in the world requires the urgency of ensuring their civil rights abroad.

The Ministry of justice provides legal assistance to citizens, foreign citizens and stateless persons in the field of civil law relations, namely such civil relations within the framework of international agreements as: (inheritance, debt collection, as well as material and moral damage, etc.), family (recovery of maintenance, marriage, custody and guardianship, paternity, etc.), housing (housing rights, registration, deregistration, etc.) and labor (confirmation of employment, establishment of work experience, etc.).

In particular, in the framework of the Commonwealth of Independent States legal assistance under the Convention on legal assistance and legal relations in civil, family and criminal matters (Minsk, 22.01.1992) and the Convention on legal assistance and legal relations in civil, family and criminal matters (Chisinau, 07.10.2002), and also on the basis of bilateral treaties on legal assistance with foreign countries (Turkey, China, Latvia, Lithuania, Czech Republic, Bulgaria, Georgia, etc.) as types of legal assistance include the following examples:

- sending letters of rogatory in civil and economic cases to the courts and competent authorities of foreign States;

- assistance in the execution of court decisions in civil and economic cases on the territory of foreign States;

- exchange of information about citizenship, termination of citizenship and renunciation of citizenship, as well as the presence/absence of a criminal record;

- reclaiming from the archives information about employment, seniority and the amount of wages of citizens;

- establishment of information about the presence of property in the property of citizens;

- sending notaries ' orders to the competent authorities of foreign countries;

- sending applications and complaints concerning various aspects of the life of citizens to the competent authorities of foreign States and etc.

Legal assistance is also provided under the Convention on the civil aspects of international child abduction (the Hague, 1980) in cases where the child has been moved to the territory of a foreign state without the consent of the child's parents (one of the parents or legal guardian).

The importance of providing international legal assistance is increasing every day. In particular, during the first half of 2020, 1403 requests for legal assistance were considered (2019 – 7530, 2018 – 11252, 2017 – 5411).

For reference: currently, legal assistance in civil, family and criminal cases is provided under 5 multilateral and 14 bilateral agreements.

Within the framework of the Convention on the civil aspects of international child abduction (the Hague, 1980), a citizen of the Republic of Uzbekistan who was illegally transferred to the territory of the Russian Federation was returned to his homeland.
