Information on the state program


Information on the work carried out by the Ministry of Justice of the Republic of Uzbekistan in the framework of the adoption of the State Program for the implementation of the Strategy of Action for the five priority areas of development of the Republic of Uzbekistan in 2017-2021 in the “Year of the Development of Science, Education and the Digital Economy”


In accordance with the Decree of the President of the Republic of Uzbekistan “On the State Program for the Implementation of the Strategy of Action for the five priority areas of development of the Republic of Uzbekistan in 2017-2021 in the“ Year of development of science, education and the digital economy ”of March 2, 2020, the Ministry of Justice of the Republic of Uzbekistan works on 8 objectives and assignments.
In addition to this, approved State Program on the implementation of the Strategy of Action for the five priority areas for the development of the Republic of Uzbekistan in 2017-2021 in the “Year of the Development of Science, Education and the Digital Economy”, 71 objectives were assigned to the Ministry of Justice of the Republic of Uzbekistan. The ministry of Justice of the Republic of Uzbekistan is the principal administrant in 8 objectives. Eventually 23 points of these objectives have already been completed, 48 points are being implemented.

I. PRIORITY DIRECTIONS ON IMPROVING THE SYSTEM OF STATE AND PUBLIC CONSTRUCTION:


Paragraph 16 of the State Program defines the measures on the development of a concept for increasing the electoral culture of the population. Currently, in order to increase the «electoral culture» of the population, the Ministry of Justice of the Republic of Uzbekistan is conducting review and analyze of legislative acts, studying current norms and international practices.
Paragraph 29 of the State Program defines the following measures for the improvement of the system for monitoring the implementation of legislative acts, the introduction of effective mechanisms for a critical analysis of the effectiveness of assigned tasks and assignments.
Thereunder, in order to further increase the efficiency of ensuring the implementation of regulatory legal acts, to prevent the emergence of standards that lead to incorrect or controversial law enforcement practices, and promptly identification and elimination, the Ministry of Justice of the Republic of Uzbekistan has developed and submitted to the Cabinet of Ministers a legal monitoring plan for 2020.
In particular, information has been entered into the Cabinet of Ministers on the proper organization of the implementation and evaluation of legislative acts, ensuring that the essence and significance of the reforms being carried out to the lower levels, and an analysis of the effectiveness of the tasks and assignments were provided. Moreover, protocol № 40 of the meeting of the Presidium of the Cabinet of Ministers approved a plan for the conduct of legal monitoring by ministries and agencies for 2020.
Paragraph 30 of the State Program defines the measures for the development of a draft (project) regulatory act in order to ensure the participation of khokimiyats (local authorities) in decision-making at the level of the republic.
In accordance with this, the Ministry of Justice of the Republic of Uzbekistan has developed and submitted to the Cabinet of Ministers of the Republic of Uzbekistan a draft (project) Resolution of the Cabinet of Ministers “On amendments and additions to the regulations of the Cabinet of Ministers of the Republic of Uzbekistan”. Thereafter, the Resolution of the Cabinet of Ministers “On amendments and additions to the Regulation of the Cabinet of Ministers of the Republic of Uzbekistan” (№ 219 14.04.2020) was adopted.
Paragraph 31 of the State Program defines the measures of the development of a draft (project) regulatory act in order to review the activities of inefficient interdepartmental collegial bodies. The Ministry of Justice of the Republic of Uzbekistan has addressed a note to the Cabinet of Ministers of the Republic of Uzbekistan on the initiation of a working group. Moreover, as part of the implementation of this paragraph, an inventory of normative legal acts is currently being carried out.
According to paragraph 35 of the State Program, a draft (project) Decree of the President of the Republic of Uzbekistan “On the establishment of a Public Chamber” was developed, after which the decree of the President of the Republic of Uzbekistan “On the establishment of a Public Chamber under the President of the Republic of Uzbekistan” of April 16, 2020 was adopted.

II. PRIORITY DIRECTIONS IN THE SPHERE OF ENSURING THE RULE OF THE LAW AND FURTHER REFORMING OF THE JUDICIAL SYSTEM:


In the framework of the implementation of paragraph 57 of the State Program, the Decree of the President of the Republic of Uzbekistan “On additional measures for major improve of a Legal Education and Science in the Republic of Uzbekistan” of April 29, 2020 was adopted.
In accordance with paragraph 59 of the State Program, plan of actions is being developed for the second international legal forum, Tashkent Law Spring.

III. PRIORITY DIRECTIONS IN THE SPHERE OF ECONOMIC DEVELOPMENT AND ACTIVE ATTRACTION OF INVESTMENTS:


In paragraph 87 of the State Program, in order to reduce licensing and authorization procedures for certain types of activities, the development of an information and analytical reference and a draft (project) regulatory act are provided. In accordance with this, an interdepartmental working group was created under the coordination of the Minister of Justice to optimize licensing and authorization procedures.
Analytical and information note was prepared and addressed to the Administration and the Cabinet of Ministers of the Republic of Uzbekistan in order to reduce licensing and authorization procedures for certain types of activities.
Thereunder, a draft Decree of the President of the Republic of Uzbekistan “On measures of radically improve licensing and authorization procedures” was developed. Currently, the draft decree has been posted for discussion in the electronic system “Project.gov.uz”.
In paragraph 89 of the State Program, in order to sharp reduce of administrative and regulatory procedures, consisting of regulations and technical documentation affecting the business, investment and competitive environment, as well as eliminating unreasonable barriers, a draft resolution of the President of the Republic of Uzbekistan will be developed.
According to this, the Ministry of Justice of the Republic of Uzbekistan is currently compiling a list of regulatory legal acts and technical settlement documents that can affect business, investment and competitive environment, as a result of which, the working group has been formed.
In paragraph 145 of the State Program, in order to develop the activities of intellectual property and improve the organization of examination of intellectual property utilizing modern IT solutions, outsourcing methods and “artificial intelligence”, a draft resolution of the Republic of Uzbekistan will be developed.
Moreover, in order to reduce the time for state analysis, the experience of the international intellectual property agency and leading foreign countries is studied.
Additionally, the Intellectual Property Agency has developed and submitted to the Cabinet of Ministers of the Republic of Uzbekistan a draft law on amendments and additions to legislative acts in the field of intellectual property.
On September 27, 2019, the Directors of the Intellectual Property Agency took part in the international discussion “Intellectual Property and Artificial Intelligence” at the World Intellectual Property Organization (in Geneva). Almost 30 speakers made presentations on artificial intelligence at this event.

IV. PRIORITY DIRECTIONS OF DEVELOPMENT OF THE SOCIAL SPHERE:


In paragraph 190 of the State Program, with a view to legal regulation of relations regarding social entrepreneurship, a draft law of the Republic of Uzbekistan «On social entrepreneurship» is being developed.
Based on this, an inventory of the base of regulatory legal acts in the field of social entrepreneurship was carried out, the legislation of foreign countries in the field of social entrepreneurship was studied. Based on the results of the study, a draft law of the Republic of Uzbekistan “On social entrepreneurship” was developed.
The draft law has been submitted for public discussion and submitted to the Cabinet of Ministers of the Republic of Uzbekistan.
